KwikLetter Mobile App Privacy Policy

JHO App, LLC ("us", "we", or "our") operates the KwikLetter mobile application (hereinafter referred to as the "KwikLetter App" or “KwikLetter”).

This page informs you of our policies regarding the collection, use and disclosure of personal data when you use our KwikLetter App and the choices you have associated with that data.

We use your data to provide and improve the KwikLetter App. By using the KwikLetter App, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Definitions

KwikLetter App

KwikLetter App is the KwikLetter mobile application operated by JHO App, LLC

DATA TYPES:  This is a list of data types that are possible for an app to collect.

Location:

  • Approximate Location:  User or device physical location to an area greater than or equal to 3 square kilometers, such as the city a user is in. 
  • Precise Location: User or device physical location within an area less than 3 square kilometers

Personal Info:

  • Name: How a user references themselves, such as their first or last name, or nickname.
  • Email address: A user’s email address
  • User IDs: Identifiers that relate to an identifiable person. For example, an account ID, account number, or account name.
  • Address: A user’s address, such as a mailing or home address
  • Phone Number: A user’s phone number
  • Race & ethnicity: Information about a user’s race or ethnicity
  • Political or religious beliefs: Information about a user’s political or religious beliefs.
  • Other info: Any other personal information such as date of birth, gender, veteran status, etc.

Financial Info:

  • User payment info: Information about a user’s financial accounts such as a credit card number.
  • Purchase History: Information about purchases or transactions a user has made.
  • Credit Score: Information about a user’s credit score.
  • Other Financial Information: Any other financial information such as user salary or debts.

Health and Fitness:

  • Health info: Information about a user’s health, such as medical records or symptoms.
  • Fitness info: Information about a user’s fitness, such as exercise or other physical activity.

Messages:

  • Emails: A user’s emails including the email subject line, sender, recipients, and the content of the email.
  • SMS or MMS: A user’s text messages including the sender, recipients, and the content of the message.
  • Other in-app messages: Any other types of messages, for example, instant messages or chat content.

Photos and videos:

  • Photos: A user’s photos.
  • Videos: A user’s videos.

Audio Files:

  • Voice or sound recordings: A user’s voice such as a voicemail or as sound recording.
  • Music files: A user’s music files.
  • Other audio files: Any other user-created or user-provided audio files.

Files and Docs:

  • Files and Docs: A user’s files or documents, or information about their files or documents such as file names.

Calendar:

  • Calendar events: Information from a user’s calendar such as events, event notes, and attendees.

Contacts:

  • Contacts: Information about the user’s contacts such as contact names, message history, and social graph information like usernames, contact recency, contact frequency, interaction duration and cell call history.

App Activity:

  • App interactions: Information about how a user interacts with the app. For example, the number of times they visit a page or sections they tab on.
  • In-app search history: information about what a user has searched for in the app.
  • Installed apps: Information about the apps installed on a user’s device.
  • Other user generated content: Any other user-generated content not listed here, or in any other section. For example, user bios, notes, or open-ended responses.
  • Other actions: Any other user activity or actions in-app not listed here such as gameplay, likes, and dialog options.

Web Browsing:

  • Web browsing history:  Information about the websites a user has visited.

App info and performance:

  • Crash logs: Crash log data from the App. For example, the number of times the app crashed, stacked traces, or other information directly related to a crash.
  • Diagnostics: Information about the performance of the app. For example battery life, loading time, latency, framerate, or any technical diagnostics.
  • Other app performance: Any other app performance data not listed here.

Device or other IDs:

  • Device or other IDs:  Identifiers that relate to an individual device, browser, or app. For example, an IMEI number, MAC address, Widevine Device ID, Firebase installation ID, or advertising identifier.

Cookies

Cookies are small files stored on your device (computer or mobile device).

Data Controller

Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be, processed.

For the purpose of this Privacy Policy, we are a Data Controller of your Personal Data.

Data Processors (or Service Providers)

Data Processor (or Service Provider) means any natural or legal person who processes the data on behalf of the Data Controller.

We may use the services of various Service Providers in order to process your data more effectively.

Data Subject (or User)

Data Subject is any living individual who is using our KwikLetter App and is the subject of Personal Data.

Hold Time

Period of time credit card companies allow disputes and corresponding resolutions.

Information Collection and Use

We collect several different types of information for various purposes to provide and improve our KwikLetter App to you.

Tracking Cookies Data

We do not use cookies and similar tracking technologies to track the activity on our KwikLetter App.

Personal Data: Types of Personal Data collected and the Use of  that Data

A list of all possible types of personal data, whether KwikLetter uses the data and if so, the purpose of the collected:

Location:
  • Approximate Location:  KwikLetter app does NOT collect. 
  • Precise Location: KwikLetter app does NOT collect.
Personal Info:
  • Name: How a user references themselves, such as their first or last name, or nickname.  KwikLetter does collect your name and signature to be used in your letters.  Your name and signature reside within the app on your mobile device. Your name and signature are transmitted to JHO Apps and our service providers for printing on paper and envelopes.  Once your letter has been printed your name and signature are deleted from our records.  An image of the envelope sent is kept in our records in case of credit card disputes.  Once the hold time for credit card disputes has passed, the image of your envelope, which shows your name and address, is deleted.
  • Email address: KwikLetter app does NOT collect.
  • User IDs: KwikLetter app does NOT collect.
  • Address: KwikLetter does collect your address to be used as your return address in your letters.  Your address resides within the app on your mobile device. Your address is transmitted to JHO Apps and our service providers for printing on paper and envelopes.  Once your letter has been printed your address is deleted from our records.  An image of the envelope sent is kept in our records in case of credit card disputes.  Once the hold time for credit card disputes has passed, the image of your envelope, which shows your name and address, is deleted.
  • Phone Number: KwikLetter app does NOT collect.
  • Race & ethnicity: KwikLetter app does NOT collect.
  • Political or religious beliefs: KwikLetter app does NOT collect.
  • Other info: KwikLetter app does NOT collect.
Financial Info:
  • User payment info: Our credit card service provider, Stripes does collect per the terms of their service.
  • Purchase History: KwikLetter app does NOT collect. KwikLetter does keep the images of the letters you sent within the app.  These images reside only within your app.  The images are not considered transaction history because they do not contain any financial information.
  • Credit Score: KwikLetter app does NOT collect.
  • Other Financial Information: KwikLetter app does NOT collect.
Health and Fitness:
  • Health info: KwikLetter app does NOT collect.
  • Fitness info: KwikLetter app does NOT collect.
Messages:
  • Emails: KwikLetter app does NOT collect.
  • SMS or MMS: KwikLetter app does NOT collect.

  • Files and Docs: KwikLetter app does NOT collect. KwikLetter does collect the letter you write within the app, but does NOT collect any of your Files and Docs that reside on you device outside of the KwikLetter app.

App Activity:

  • In-app search history: KwikLetter app does NOT collect.

  • Other user generated content: KwikLetter does collect the subject line, body of the letter you create and the names and addresses of the recipients of your letter, “Letter Content”.  Your Letter Content resides within the app on your mobile device. Your Letter Content is transmitted to JHO Apps and our service providers for printing on paper and envelopes.  Once your letter has been printed your Letter Content is deleted from our records.  An image of the envelope sent is kept in our records in case of credit card disputes.  Once the hold time for credit card disputes has passed, the image of your envelope, which shows your name and address, is deleted.
  • Other actions: KwikLetter app does NOT collect.
Web Browsing:
  • Web browsing history:  KwikLetter app does NOT collect.
App info and performance:
  • Crash logs: KwikLetter app does NOT collect.  Apple and Google collect anonymized crash information and share with JHO Apps per their respective developer stores.
  • Diagnostics: KwikLetter app does NOT collect
  • Other app performance: KwikLetter app does NOT collect
Device or other IDs:
  • Device or other IDs:  KwikLetter app does NOT collect.

Legal Basis for Processing Personal Data under the General Data Protection Regulation (GDPR)

KwikLetter only operates in the United States.  This section about the European Economic Area is only included because it is required of a privacy policy.  This section does not apply to KwikLetter because we do not operate in the EEA.

If you are from the European Economic Area (EEA), JHO App, LLC legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

JHO App, LLC may process your Personal Data because:

  • We need to perform a contract with you
  • You have given us permission to do so
  • The processing is in our legitimate interests and it is not overridden by your rights
  • For payment processing purposes
  • To comply with the law

Retention of Data

JHO App, LLC will retain your Personal Data only for the Hold Time and any additional time as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes  and enforce our legal agreements and policies (for example, retain images of letters and/or envelopes to demonstrate receipt of letters for mailing, in case of credit card disputes).

Unless otherwise required by law, letters you present to JHO App, LLC are stored only for the period of time it takes to print your letter(s) corresponding envelope(s) and credit card payments have been cleared beyond dispute periods.  After such time, your letters, and all the information they contain, are deleted.  Images of envelopes may be retained for a longer period of time.

Transfer of Data

Your information, including Personal Data, may be transferred to - and maintained on - computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to United States and process it there.

Some of your information including Personal Data is included on the letters you write, in particular, your name, return address and phone number (if you choose to include your phone number in your letter).  This information is transferred on paper to the government official you are writing but is not transferred electronically. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

JHO App, LLC will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

Disclosure of Data

Disclosure for Law Enforcement

Under certain circumstances, JHO App, LLC may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

JHO App, LLC may disclose your Personal Data in the good faith belief that such action is necessary to:

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Our Policy on "Do Not Track" Signals under the California Online Protection Act (CalOPPA)

We do not support Do Not Track ("DNT").  Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

We do not support DNT because we do not track your location.

KwikLetter only operates in the United States.  This section about the European Economic Area is only included because it is required of a privacy policy.  This section does not apply to KwikLetter because we do not operate in the EEA.

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. JHO App, LLC aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Data.

The right to withdraw consent. You also have the right to withdraw your consent at any time where JHO App, LLC relied on your consent to process your personal information.

Please note that we may ask you to verify your identity before responding to such requests.

Service Providers

We may employ third party companies and individuals to facilitate our Kwikletter App ("Service Providers"), provide the Service on our behalf, perform Service-related services or assist us in analysing how our Kwikletter App is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics

We do not gather any information for analytics from the KwikLetter app and thuse we do not use third-party Service Providers to monitor and analyse the use of our Kwikletter App.

Payments

We provide paid products and/or services within the KwikLetter App. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Our KwikLetter App  does not contain links to other sites that are not operated by us. 

Children's Privacy

Our KwikLetter App does not address anyone under the age of 18 ("Children").

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.  Please keep in mind, we delete all the data within a short period of time after printing your letter.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our KwikLetter App, prior to the change becoming effective and update the "effective date" at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
